This privacy policy sets out how Abby Lane collects, uses and protects your personal data when you use this website and through other means of collecting data.

In this policy, “we”, “us” and “our” refer to Abby Lane.

Abby Lane is the Data Controller (i.e. the person or organisation who decides the purposes for which and the way in which any personal data is processed) as defined in the EU General Data Protection Regulation 2018.

Collection and processing of data
I operate secure data networks protected by industry standard firewall and password protection systems.

During our counselling relationship together information will be gathered regarding the nature of the issues you are presenting along with logistical and contact information.  The privacy of this information is of upmost importance to the trust we build in the counselling relationship.

Minimum information shall be recorded if absolutely necessary and not shared with any third party except in the event of a court subpoena.

Your privacy is of the utmost importance. Because I gather certain types of information about my clients, I feel you should fully understand the terms and conditions surrounding the capture and use of that information.

I am registered with the Information Commissioners Office. All submitted information is processed in accordance with the EU General Data Protection Regulation 2018.

If we collect any information by which you can be personally identified, you can be assured it will only be used in accordance with this privacy policy. We do not and will not ever share information about individual users with any third party, except where we are required to do so to comply with any applicable law or valid legal process or to protect the personal safety of our users.

This includes our website being a secure (https) website so that the data you enter in your browser is encrypted before being sent to our server. 

How we keep your personal data secure
We are committed to ensuring that your information is secure and that your privacy is protected. We use reasonable organisational, technical and administrative measures to protect your personal data. 

How we use cookies
A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

Information Collected by my Contact Forms

This website collects and processes personal data including (but not limited to) your name, e-mail address and phone number. The data is collected via enquiry forms and for one of the following reasons:

  1. to respond to an enquiry
  2. to process an order or booking.
  3. to help us effectively deliver a service.

The data submitted in forms is automatically e-mailed to us by our server. These e-mails are sent using ‘Opportunistic TLS’ which means an attempt is made to send the e-mail in an encrypted form. However this is not always successful and we cannot guarantee that the e-mail will be encrypted. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.

This information is collected for the purpose of contacting users with a view to responding to their queries. The information collected in this way is used for no purpose other than this. If you decide to contact me using the contact details provided on my website, then in the course of our conversation I may make a note of your name and contact details, and any other relevant information addressed. If we subsequently end up working together, we will agree and complete a working agreement between us for this work.

IP addresses
An IP or Internet Protocol Address is a unique numerical address assigned to a computer as it logs on to the internet. Under the EU General Data Protection Regulation 2018, IP addresses are considered to be personal data. When you visit our website our server keeps a record of your IP address in the logs. This is done to help detect and prevent fraud and unauthorized access and to maintain the security of our systems.

Non-personal data
This site uses Google Analytics (GA) to track visitor interaction. We use this data to understand the number of people using our site, how they find and how they use our site. Although GA records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us. GA also records your computer’s IP address which could be used to personally identify you, but Google do not grant us access to this. We consider Google to be a third party data processor. GA makes use of cookies. Disabling cookies in your browser will stop GA from tracking any part of your visit to pages within this website.

Information Collected by Text or WhatsApp

I cannot guarantee that all correspondence via Text or WhatsApp are GDPR compliant. 

Information Collected for payments

If you make a payment via the contactless card machine at our sessions, your card information will not be held by myself. It is collected by our third party payment processors who specialise in the secure online capture and processing of credit/debit card transactions. 

Retention of personal data
We will hold your personal data on our systems for as long as we deem necessary for the relevant activity.

Brief notes will be kept on each session and I confirm that they will be kept securely in a safe place where no other can access them. They will not be shared with anyone else. I am legally obliged to keep these notes for 6 years and then they will be destroyed.

Lawful basis for the processing of personal data
When processing your personal data to reply to enquiries, the lawful basis we use for processing your personal data, as defined in the EU General Data Protection Regulation 2018, is ‘legitimate interest’.

When processing your personal data to send marketing communications, the lawful basis we use for processing your personal data, as defined in the EU General Data Protection Regulation 2018, is ‘consent’.

When processing your personal data to accept and fulfil an order or booking, the lawful basis we use for processing your personal data, as defined in the EU General Data Protection Regulation 2018, is ‘contract’.

When processing your IP address, the lawful basis we use for processing your personal data, as defined in the EU General Data Protection Regulation 2018, is ‘legitimate interest’.

Access to Information

Under the EU General Data Protection Regulation 2018 you have the following rights that are relevant to how we collect and process your personal data:

  2. The right to access the data we hold on you.
  3. The right for incorrect data to be rectified.

We may use your personal information to send information about third parties which we think you may find interesting if you have specifically given your consent for this to happen.
